Will Obamacare Drive Out Employer-Sponsored Insurance? | The ...

Many opponents of Obamacare claim that large employers will drop employee health coverage in droves. The Wall Street Journal has made this argument a centerpiece of its opposition to the health exchanges. The argument has some face validity ? employers that drop coverage can save about $10,000 per employee in insurance costs but only have to pay fines of $2000 per employee. What employer would not want to save $8000 per employee?

Supporters of Obamacare argue that if employers do not pay for insurance, they will have to increase wages. This will temper the incentives of employers to drop coverage. This follows from a classic model in labor economics that says that employers have to give workers a competitive wage/benefits bundle, and that the mix of wages and benefits is largely fungible. Thus, if benefits fall by $10,000, wages will increase by about the same amount. The theory is well accepted.

While it has been difficult to construct empirical tests of this theory, the available evidence is largely supportive (though the evidence of 1:1 fungibility is less compelling than the evidence of some degree of fungibility.) This may explain why the Congressional Budget Office predicts that only a few million workers will lose their employer sponsored coverage and get pushed onto the exchange. Even so, the Wall Street Journal and others have dismissed this theory and evidence, arguing that employers who drop coverage will pocket the full savings and therefore than tens of millions of workers will be affected.

I want to propose a simple test of the naysayers? position. The test relies on evidence that the Wall Street Journal and others should find unimpeachable ?stock market valuations. This is a quick and dirty test but the results are so compelling that I think it is sufficient.

I rely on some basic labor market data. Consider that American firms pay workers about $60,000 annually in average compensation and benefits. Moreover, these labor expenses represent about two-thirds of the total cost of production. Now suppose that firms can reduce their wage/benefit package by $4000 by dropping $10,000 in insurance coverage, paying a $2000 fine, and increasing wages by just $4000. In other words, I am supposing that there is 0.5:1 fungibility between wages and benefits. (I get similar qualitative findings with any ratio that is substantially less than 1:1, as the naysayers are assuming.) This savings reduces total compensation costs by 6.7 percent and therefore reduce total production costs by 4.4 percent. In effect, this simple move would increase returns on sales by 4.4 percent! This would effectively double the average return on sales for U.S. manufacturing firms (which is currently about 5 percent) and represent an even bigger increase in retail and other industries.

If the naysayers are correct, then the passage of Obamacare should have had a remarkably powerful impact on the stock market. Share values should have doubled and then some! And the effect should have been immediate, as investors could have performed the same math as I have just done and seen the good times ahead. Of course this did not happen. I can only conclude that investors did not and do not expect large employers to reap a windfall from Obamacare. Large employers that drop coverage will have to increase compensation to workers to make up for the difference. Obamacare does not provide a free lunch to employers, and this is why the CBO and others expect such a small impact on employer-provided coverage.

What I find most remarkable is that the Wall Street Journal is a staunch believer in free markets, yet it conveniently ignores market mechanisms when it wants to make a political point.

Samsung Galaxy Designer Takes Apple?s Accusations Personally

We all know Apple?s industrial designs come by way of Jonathan Ive, but who?s designing the devices that Cupertino claims are copycats? At Samsung, it?s someone who seems to take as much pride in his work as Ive does.

Reuters has a fascinating study on the work that goes into designing Samsung?s Galaxy series, which has drawn the ire of Apple as being slavish copies of the iPhone, iPod touch and iPad. As it turns out, that work is the creation of 40-year-old Lee Minhyouk, the youngest senior executive at Samsung?s Seoul-based headquarters, who has led the company to success with 44 million Galaxy-branded devices sold since launching the summer of 2010.

Despite their success, not everyone is impressed by Samsung Mobile?s vice president for design. Chief innovation officer of service design for Fjord Christian Lindholm likens Samsung to making soap. "Their products get you clean, lathers well,? the Finland-based executive says. ?However, they do not know how to make perfumes, an industry where margins are significantly higher. Perfume is an experience. Perfume is meant to seduce, make you attractive and feel good. You love your perfume, but you like your soap."

To be fair, Samsung?s Lee doesn?t claim to be the next Jony Ive -- but feels he may be one great product away from such acclaim. "I might not be at (Ive's) level yet, but I believe Samsung will produce such iconic products one day,? the designer reveals. ?It's not just effort that makes it possible for a new product to be a massive hit. It also has to be timely, and technology should be ready to make a certain design a reality."

And what of Apple?s charges that Samsung has ?slavishly? copied the iPad and iPhone? Not surprisingly, Lee takes it personally.

"I've made thousands of sketches and hundreds of prototype products (for the Galaxy),? Lee explains. ?Does that mean I was putting on a mock show for so long, pretending to be designing? As a designer, there's an issue of dignity. (The Galaxy) is original from the beginning, and I'm the one who made it. It's a totally different product with a different design language and different technology infused."

That may eventually be decided by the legal system, as Apple and Samsung continue to duke it out over patents. Meanwhile, Samsung is headed in another direction, going ?back to the future? with the Galaxy Note -- reintroducing a stylus pen to a world already comfortable using what Steve Jobs called the best stylus ever made: Your finger.

John Dvorak's Second Opinion: Microsoft may be poised to challenge Apple

BERKELEY, Calif. (MarketWatch) ? Right now, Microsoft Corp. seems poised to do something bold: go into the computer business to compete with Apple Inc.

This is possibly being done under the guise of its new emphasis on the Xbox360 and the upcoming Xbox720 which maybe be previewed later this year.

An article in the superb All About Microsoft blog by Mary Jo Foley titled, ?Is Xbox the new center of the Microsoft universe?? reveals some interesting changes at the company. It led me to this conclusion. Read blog post.

Her post stems from some interesting commentary by an employee who has shuttled back and forth between Microsoft /quotes/zigman/20493/quotes/nls/msft MSFT +0.05% ?and Google. It reveals the fact that Microsoft is quietly targeting the Xbox division as a primary focus. Microsoft may have finally realized that the Xbox can become more than a game console.

When the Xbox360 was first shown, I recall seeing some demos of its media server capabilities. At the time though, to be fully implemented users had to have a special version of Windows XP called Windows XP Media Center Edition.

The problem was nobody ever heard of Windows XP Media Center Edition, and those who did hear of it never knew what it was for. The company never sent samples of the product to the media, that I know of, and never lectured anyone about its power.

The capabilities of the Media Center idea kept growing nonetheless and many casual users of the Xbox360 essentially are running an IPTV lashup through their TV sets after having installed Netflix on the Xbox360.

In essence, they are streaming TV shows through the Xbox from the Internet to the TV set.

Microsoft has done a very poor job of pushing the capabilities within the Xbox division. Instead it spins its wheels on the Windows Phone and Bing fearing an overall threat from Apple /quotes/zigman/68270/quotes/nls/aapl AAPL -0.55% ?and Google Inc. /quotes/zigman/93888/quotes/nls/goog GOOG -0.54% ?, respectively.

This may be changing if Microsoft can realize it has a market all to itself and a real competitor to Apple if it can make the Xbox720, or whatever it is called, a full blown computer that is also a game console. I?m thinking Xbox-PC.

The reason I suspect this is going on is that in January Microsoft moved operating system guru and genius David Cutler to the Xbox division. I didn?t see the significance of this when it happened. But now I do.

IPBiz: O'Malley's dissent in Byrne in the legal malpractice area

In Byrne v. Wood, Herron , on the subject on legal malpractice cases in the patent area [PETITION FOR REHEARING EN BANC denied ], Judge O?MALLEY authored a lengthy dissent, arguing against federal jurisdiction.

From the dissent, giving background on the case:

The gist of Byrne?s malpractice case is that defendants negligently failed to secure broader patent protection for his invention from the United States Patent and Trademark Office (?PTO?), and, as a result, Byrne was unsuccessful in a subsequent patent infringement lawsuit against Black & Decker Corporation and related entities (collectively, ?Black & Decker?). See Byrne v. Black & Decker Corp., 2007 WL 1492101 (Fed. Cir. May 21, 2007). All agree that Byrne?s claim is a purely state law claim for which federal law creates no cause of action.

AND

On appeal to this court, a majority of the panel agreed that our current case law extended ? 1338 jurisdiction over this action but noted that, because it is inconsistent with Supreme Court precedent, that case law should be revisited. See Byrne v. Wood, Herron & Evans, LLP, 2011 WL 5600640, at *5 (Fed. Cir. Nov. 18, 2011) (?Although we must adhere to our precedent, we believe this court should re-evaluate the question of whether jurisdiction exists to entertain a state law malpractice claim involving the validity of a hypothetical patent . . . .? (emphasis in original)). The panel then reluctantly resolved the merits of the appeal, and this petition for rehearing en banc followed.

Nonprofit: North Korea orchestra plans to visit US

ATLANTA (AP) ? An Atlanta-based nonprofit is planning to bring North Korea's national orchestra to the U.S. for a tour that would start in Atlanta, according to the group's president.

The North Korean National Symphony Orchestra would bring 164 musicians and journalists for an 18-day visit that would also include stops in Oxford, Miss., and New York, said Robert Springs, the president of Global Resource Services, a humanitarian group that works in North Korea.

He said he hopes the visit will take place in the spring but the details are still being worked out and it awaits government approval. Springs has scheduled a press conference on Thursday to release more details about the trip. The U.S. State Department did not immediately comment.

Springs' group has sent three musical groups to North Korea over the last 14 years, including Christian rock group Casting Crowns.

"The hope is that we can better understand the people of North Korea and that they can better understand us," he said. "And that could lead to more normalized relations."

The deal comes amid encouraging signs that ties between the U.S. and North Korea could be warming.

Both nations announced an agreement last month that calls for Pyongyang to freeze its nuclear activities and allow U.N nuclear inspections in exchange for food aid. But Washington said the North's recently announced plans to launch a satellite on a rocket could jeopardize the deal.

A U.S. tour by North Korean musicians would take place four years after the New York Philharmonic performed in Pyongyang, North Korea's capital, in January 2008 ? a historic cultural exchange between musicians from two nations that remain enemy states.

Korea was split at the end of World War II into the communist North and the U.S.-backed South. The two sides fought a three-year war that ended in a truce in 1953 but has left the Korean Peninsula divided by a heavily fortified border. The U.S. still has more than 28,000 troops stationed in South Korea.

North Korea has sent a flurry of recent cultural exchanges. The South Korean conductor of the Seoul Philharmonic Orchestra landed in Pyongyang in February to rehearse with North Korea's Unhasu Orchestra. The Unhasu Orchestra performed a landmark concert with a French orchestra last week in Paris.

Amber's brother 'thrilled' 'Teen Mom is ending

Amber Portwood of "Teen Mom" has faced a number of legal issues since the show launched.

Fans of the MTV megahit "Teen Mom" were saddened last week when the network announced that the upcoming season would be the show?s last.? Viewers first met the show?s stars -- Maci Bookout, Farrah Abraham, Amber Portwood and Catelynn Lowell?-- back in 2009 during the first season of the MTV docuseries "16 & Pregnant" and have watched their lives unfold through breakups, baby milestones, engagements and even trouble with the law.

While some will miss the popular spinoff, others feel "Teen Mom" has run its course and it?s time for the young women to experience life ? without the MTV paycheck.

?I am thrilled,? Shawn Portwood, the brother of troubled "Teen Mom" star Amber, told TODAY.com. ?I do not believe that the show should have survived more than a year or two at the most. I am happy that (the stars) actually have to pursue their lives now.?

Amber has seen her share of legal woes lately, all stemming back to an arrest in 2010 for an incident that was shown on "Teen Mom" in which Amber got physically violent with her baby?s father, Gary Shirley. She was arrested a few weeks after the episode aired and has been in trouble with the law ever since. She recently spent nearly two months in jail and is currently out on probation and participating in an outpatient rehab program.

According to her brother, Amber hasn?t had much time to reflect on the end of the show, despite the fact that she will lose her only income when it does finally go off air.

?She has been so busy doing other things,? Sean told us.??Amber has been getting up every day at 6 a.m. to go to the courthouse and submit drug screens and everything else.?Amber physically has no time to worry about MTV.?

Shawn added that he is excited to see the girls have to grow up and live the normal life of a young parent who doesn?t have an MTV paycheck to rely on to pay their bills.

Viewers of the show have watched as the young moms have rented homes, purchased?new cars?and even gotten?plastic surgery procedures despite the fact that very few of them have a "real" job. With the MTV paychecks coming to an end, the ladies will either have to return to normal life or use their "Teen Mom" fame to help them stay in the spotlight.

?I am sure they will try to milk the television scene as much as possible,? Shawn said. ?(Amber) is ready for a 9-to-5 (job) and hopefully she can get a little extra money on the side doing other things. It is time to get Amber out of the spotlight, which is what she has been trying to do since she has been out (of jail).?

The fourth and final season of "Teen Mom" will begin airing this summer. MTV has yet to comment on the fate of the franchise?s other shows, "Teen Mom 2" and "16 & Pregnant." However, last month the network released a statement confirming that it will be launching "Teen Mom 3" with girls from the upcoming season of "16 & Pregnant."

While the new girls seem promising, it will be hard for the new batch?to surpass the drama factor that the original bunch have brought to the show.?Loyal fans will miss Amber and Gary?s constant breakups, the drama between Maci and her baby-daddy Ryan, the strength of adoption advocates Catelynn and Tyler, and, of course, Farrah?s often-mocked ?cry face,? which has made it into nearly every episode of the show.

Kroll Ontrack , the leading provider of data recovery , information management and legal technologies products and services , today released new statistics regarding how the creation of storage technologies and digital information has impacted data loss and data recovery technology since the advent of the personal computer in the 1980?s.

Since the first Kroll Ontrack data recovery lab opened in 1987, more than 103 petabytes of data, which could be stored on 25 million USB flash drives with 4 GB capacity, has been recovered. This compares to 1.2 GB of data initially recovered in 1987, which is one five hundredth of the capacity available on today?s average hard drive. However, in 2011, the amount of data recovered by Kroll Ontrack was nearly 35 million GB (35 PB) while the number of computers estimated to be impacted by data loss reached nearly 1.4 million compared to 33,000 in 1987.

According to an analysis by Kroll Ontrack, the number of data loss cases over the past 25 years grew in parallel with the total number of personal computers in the world. The analysis also revealed that on average, one in one thousand computers lost data stored on it. In the 1980?s, at the onset of the so-called PC era, the estimated number of personal computers in use was nearly 7,000 devices per one million people and approximately 33,000 of them suffered data loss. By the mid 1990?s, the number of computers in use was nearly 40,000 per one million people and data was lost from approximately 225,000 computers. In 2011, these figures reached more than 200,000 computers and 1.4 million cases of data loss, respectively.

?In the past 25 years, the worst cases Kroll Ontrack has seen have coincided with natural disasters, which included burned, water logged and physically damaged drives,? said Todd Johnson, vice president of operations, Kroll Ontrack. ?Despite this, even in extreme situations, Kroll Ontrack has been successfully recovering incredible amounts of digital information in both our global recovery labs and cleanrooms. For example, one of the company?s most successful endeavors was the recovery of more than 99 percent of mission-critical data from a melted, crashed and burned drive from the 2003 Space Shuttle Columbia.?

According to the latest IDC Digital Universe study, the amount of data more than doubles each year, and in 2012, it will exceed 1.8 zettabytes. This is the equivalent of 200 billion two-hour long HD movies that one person would have to watch continuously for 47 million years. As data creation increases, so does data loss. According to a report by market research firm Gartner, every year at least 25 percent of computer users worldwide experience data loss. Kroll Ontrack statistics indicate that 29 percent of data is lost as a result of hardware failure and 27 percent is due to human error. Other causes include software errors (7 percent), computer viruses (7 percent) and natural disasters such as floods or fires (3 percent).

?You cannot go through day-to-day life without interfacing with some form of digital data,? said Jeff Pederson, data recovery manager, Kroll Ontrack. ?As technology advances to include virtualization, cloud, and social media, individuals, businesses and of course data recovery specialists have to evolve to address these storage mediums and the new challenges they present. Businesses not only have to update their policies and data security practices, but should also investigate and denote a data recovery provider who has proven experience in addressing the latest technologies in their disaster recovery plans.?

SCOTTSDALE, Ariz. -- Amid a report that contract negotiations have stalled between the Giants and Matt Cain, the right-hander acknowledged that he is ?really torn? about whether to commit long-term or test the market as a free agent after the season.

Although many observers expected a swift resolution to Cain's contract situation, Zito said he wasn't surprised that it hasn't turned out that way.

?It?s more complicated than, `The Giants want Cain and Cain wants to stay,'" Zito said. "This is a game and we try to keep it that way in most aspects. But the fact is, it?s a business. You?ve got to be as tedious about getting business handled as you are about stuff on the field. That?s just a fact.?

Cain would start the Giants? home opener April 13 if the club uses four starting pitchers in the first turn through the rotation.
